COLLEGE ELECTION RULES – 2005

i) Funds of the College union and all societies/associations shall be under the custody of the TITLE :
These Rules shall be called College Election Rules – 2005.
DEFINITION :
“Rules” shall denote rules/principles governing the conduct of students’ Election.

SCOPE:
The scope of these Rules shall be confined to Tarini Thakurani Mahavidyalaya, Ghatagaon, Dist Keonjhar, that shall in no case contradict the Government circular published from time to time. The Principal shall have the discretionary power to adopt, reject any or all rules except those passed by the Government without assigning any reason there of. The decision of the Principal which cannot be challenged in any legal forum is final.

ELECTION :
The Principal after consultaion with the Election Officer and after the publication of Government Notification in matters of students’ Election shall notify the conduct of students’ Election to different offices of students union, +2 Cultural Association and allied /Association /Society /Clubs at least seven days before the commencement of the Election provided that a congenial and peaceful atmosphere prevails in the college. The Principal shall have the power for not conducting the Election if it goes against the interest of the college and threatens the academic climate of the college.

NOTIFICATION :
Notification for holding the Election shall comprise the list of offices, the eligibility of the candidate and detail programme of Election. The

desirous bonafied and eligible students, may be informed through notice to file nominations.

ELIGIBLITY :
i) For participation in the college election a student should be on the roll and should have cleared up all dues and renewed his/her Identity Card.
ii) He/she should have 50 percent of attendance in all subjects taken together.
iii) Apart from the above the Rules or the Directives of the Government from time to time shall be inforce.

NOMINATION :
i) Notice for sale of Nomination Forms shall be given sufficiently ahead of the date of nomination.
ii) The candidates shall have the liberty to purchase as many nomination forms as he like by paying Rs. 2.00 (Rupees two) each.
iii) The candidates shall bring with them a proposer and a seconder, who shall have the minimum eligibility condition.
iv) The candidate the proposer and the Seconds shall come to the Attesting officer on the day and time specified for the proposer of attestation with renewed Identity Card.
v) It is the responsibility of a candidate to see that his proposer has not proposed another candidate for the same office.
vi) The candidate should fill in the Nomination Form legibly and meticulately in his own hand writing and put his signature in the appropriate place in the presence of the Attesting Officer.
vii) It is the responsibility of the candidate to see that the proposer and the seconds do not leave the attesting venue without putting their signature in the specified space in the presence of the Attesting Officers.
viii) No Nomination shall be accepted after the Schedule time.
ix) The start and closer of Attention shall be denoted by single stoke.

SCRUTINY :
i) The Onset and closer of the time for scrating on the day specified shall be indicated by single stroke of Bell.
ii) The candidates their proposer and senconders shall be allowed to remain present at the time of scrutiny.
iii) The Nomination shall be rejected on the following grounds and the

grounds specified elsewhere.
a) If the entries are incorrect.
b) If the form is not complete in all respect.
c) If the entries contradict the notification.
However, the Principal shall be the final Authority to resolve all ambiguities and disputes or the matter may be referred to the Jury.

VALID NOMINATIONS :
i) All valid Nominations shall be notified on the specified day. The candidate shall have the liberty to withdraw his/her candidatue.
ii) The names of the candidates contesting for different offices shall be notified after withdrawal. The copy of such notices shall be forwarded to different quarters for information.

WITHDRAWAL :
i) For the purpose of withdrawal the candidate shall submit an application in preseribed proforma in person to the Election Officer on the day and time specified. The proforma can be had on request.

CAMPAIGNING :
i) All candidates and their supporters shall be guided by the Rules of discipline. Any undesirable and objectionable gesture by the candidate or their supporters shall be seriously viewed that may result in cancellation of the candidature.
ii) At the time of campaigning no one should use unparliliamentary words, cast aspersions on others or reflect on others character.
iii) It is the sole responsibility of the candidate to see that neither he/she nor his/her supporters destroy or disfigure the College Building and its property.
iv) The candidates shall not be allowed to fix their posters and hoardings. The college authority will exhibit their names and the offices they are contesting for in a prominent place.
v) Any misconduct by the candidates or their supporters will be dealt with seriously.
vi) The candidates will be given a scope to speak to the voters in their favour in the what I stand for meeting.

BALLOT PAPER
i) The ballot paper will contain the names of the contesting candidates and the offices they are contesting for in alphabetical order.
ii) The ballot papers should be signed by the presiding officers at the backside bottom.
iii) The ballot papers should be folded first vertically then horizontally which should be demonstrated by the polling officer before handing over the ballot paper and the Arrow cross mark to the voter.
iv) The voter should be instructed to put the vote in the ballot box himself/herself.
v) In no case a voter should speak or communicate to any one about his decision.

POLLING :
i) There will be a warning bell 30 minutes before the commencement of polling.
ii) The agents, candidates, voters if present may sign on the certificate before sealing.
iii) The start and closure of polling will indicated by a single stroke of bell.
iv) All voters with discipline and having renewed Identity Cards should enter the polling booth and present their IC to the polling officer.
v) The Voter has to put his/her signature in the space provided for the purpose after verification by the secretly.
vi) The voter has put the Arrow cross mark in the voting area of the candidate of his/her choice secretly.
vii) No one except the voters polling personnel and officer so authorised should enter the polling booth.
viii) The voters should note that their votes will be rejected if the Arrow cross mark has crossed the demarcating line/lines or if the Arrow cross mark has been given in the spaces of more than one candidate.
ix) There will be a warning bell 5 minutes before the closure of the poll. The polling officers should issue chits before 5 minutes to the voters present in the polling area in order to allow them to exercise their franchise beyond the voting time. For doing so the voters so assembled

should be asked to sit inside the booth the doors of which should be shut. This is applicable only for eligible voters.
x) Campaigning in the booth or at the door is prohibited. Any one found or reported violating the rules by the roving squad will be penalized.

COUNTING OF VOTES :
i) The counting of votes will begin in time.
ii) It is the responsibility of the candidates to remain present or authorize their agents to remain present at the time of counting.
iii) A candidate may appoint agents for polling or counting or both by issuing credential letter in plain paper or prescribed form as the case may be. He should put his signature and attest the signature of the agent o be appointed. This should necessarily be countersigned by the special officer on duty for the purpose. This agents so appointed or the candidates have to sign on a declaration as to the fact that they are satisfied with the counting and shall have no objection in future.
iv) There shall be the provision for the recounting of votes provided.
a) The difference of total number of votes is 2 (two) or less than two.
b) The candidate applies for it depositing recounting fees of Rs. 100/- Rupees one Hundred only)
c) However, not withstanding the provisions for recounting the Principal shall have the power to delay grant or reject, the appeal if situation so demands.
d) No application for the purpose shall be entertained if it is not filed within 01 hour from the time of declaration of result.
e) In case of a tie, the matter will be decided by toss in the presence of recounting.

DECLARATION OF RESULTS :
The names of the candidates elected will be declared / notified as early as possible after the final round of counting has been over.

OATH TAKING :
i) The elected officers will assume office after they have taken the oath.

i) The date and time of oath taking shall be notified by the Principal as per the Government circular.

TENURE OF OFFICE :
The tenure of office of a elected office bearer will be over at the moment he/she receives his/her admit card of Council or University Examination or on 31st May whichever is earlier.

VACANCY :
All vacancies will be filled up by nomination of office bearers by the Principal.

CONCLUSION :
i) In all matters relating to election the ruling of the Principal shall be final and binding.
ii) This notification supersedes all other notification published elsewhere by the college and provisions prior to the date of its publication i.e. the 23rd day of September, 2005.
iii) Not withstanding the provisions the Principal shall have the right to cancel any or all the procedure without assigning reason thereof.
